Monumental Editions

On the Monumental Platform, artists can create unique digital assets such as visual artwork, animations, audio, and photographs (the “Content”). These assets are considered limited-edition digital items and are associated with a digital certificate that verifies their authenticity and ownership.

To link the Content to a token, the platform uses Smart Contracts, which are self-executing contracts with the terms of the agreement directly written into the code. Smart Contracts facilitate the creation and management of tokens on the platform.

However, since the Monumental Platform operates on the Ethereum network, which is a blockchain platform, transactions involving Smart Contracts require the payment of a transaction fee called the "Gas Fee." Ethereum's Gas Fee is a mechanism to allocate computational resources and prevent spam or misuse of the network. Each operation or transaction on the Ethereum network, including token creation, requires a certain amount of gas, which is paid for using the cryptocurrency Ether (ETH).

Therefore, when an artist utilizes a Smart Contract on the Monumental Platform to create a token, they need to pay the Gas Fee in ETH to cover the computational resources required for that transaction to be processed on the Ethereum network. The Gas Fee amount can vary depending on the complexity of the transaction and the current network congestion.

Standard Edition

Each time you create a Standard Edition and subsequent edition,, the Monumental Platform utilises a Smart Contract to conduct a digital certificate and a token creation. This means that you will need to pay a Gas Fee for each creation.

Community Edition

Each time you create a Community Edition and subsequent edition, the Monumental Platform utilises a Smart Contract to conduct a digital certificate creation. This means that you will need to pay a Gas Fee for each creation.
In case of interest of Your Community Edition by a Collector and the subsequent mint of the "Content" by such Collector, the Collector will incur the cost of the Gas Fee.

Liberty Edition

Note

You understand that uploading Your Content does not create any rights, protection or certificate of ownership of any kind and that the purpose of the Monumental Platform is solely to offer visibility to artists and therefore to create a free space where “Collectors” will be able to select and mint available Contents.

In case of interest of Your Content by a Collector and the subsequent mint of the Content by such Collector, You will then receive the relevant Seller certificate, the Collector will receive the relevant NFTs (NFT” in means a non-fungible token or similar digital item implemented on the Ethereum blockchain, which uses smart contracts to link to or otherwise be associated with certain content or data.) certifying the ownership of digital artworks. You do not have to pay any fee to upload "Your Contents" into the Monumental Platform.

General conditions applicable for all editions

As Monumental Platform user, You accept the terms and conditions that You sign while creating an account and uploading "Your Contents" to our Monumental Platform, and You warrant the following:

  • You are the author of all the Contents You upload;
  • You are the owner of and/or have duly acquired unencumbered intellectual property rights and all other necessary rights in and to the Contents, and has unconditional and irrevocable right to grant to Monumental’ the rights, license and authority specified herein;
  • You are 18 or older and You possess all the required documents and rights allowing You to display and use Your contents as well as their related elements (model releases, property releases, etc.).
  • The supplied Contents do not contain harmful program code, viruses, worms, Trojan horses, or any invasive, destructive or malicious software; they do not contain other mechanisms or devices designed for the purpose of or may be used for the removal, modification, disruption, or damage of Contents or any of the Monumental Platform;
  • The Contents contain full, necessary and sufficient cover information for their effective sale at the Monumental Platform; the supporting information is complete and accurate, and does not contain false, inappropriate or contradictory meta-data;

By Uploading Contents, You warrant, represent and guarantee that:

  • Each Uploaded Content had never been used and would never be used for the creation of a trademarks or registered trademarks;
  • All Contents that include name, voice, likeness or other recognizable depiction of people or property are accompanied by the appropriate permissions;
  • The Contents are original works;


    You authorize Monumental to distribute and license "Your Contents".
  • Contents shall be uploaded according to the format instruction given by Monumental. Monumental alone decides which of the Contents submitted are suitable for posting on the Monumental Platform. In addition, You agree that all Contents Uploaded by are subject to the rules of Monumental Platform.
  • Monumental and potential license-owners have the right to reproduce, use, publish, republish, compress, and transfer Contents, as well as the rights to alter, modify, create and sell prints or copies created using different technologies, and to exhibit, display publicly and replicate Contents.
  • You grant the right and a lifetime warranty, worldwide, exclusive or non-exclusive, non-transferable (sub)licenses to end-users in full compliance with the terms of the Monumental Platform.
  • Monumental reserves the right to use the Contents as part of its own activities or activities of third parties related to the issuance of licenses for the Contents, promotional purposes, marketing and advertising. You agree that You will not be paid commissions on the use of "Your Contents" for such purposes.

Monumental forbids uploading any Contents in violation of a copyright, patent, trademark, right to property or any other similar and applicable law or proprietary right. You acknowledge and agree that Monumental, its management, office workers, employees, agents or partners are not liable for any direct or indirect damages resulting from intentional or accidental acts resulting from the use or inability to use any Contents available on the Monumental Platform.

Monumental has the right to remove, delete, block or edit any Content or portion thereof that may be considered by Monumental as violating this term and condition or the rights of private or intellectual property, including similar rights of third parties, or being otherwise unacceptable. However, as Monumental has no ability to control the paternity of the Contents, it is understood that Monumental shall not be involved in the resolution of any intellectual property disputes related to "Your Contents".


To terminate You should send notification to Monumental. Monumental can also terminate the Agreement at any time and for any reason.
In the case of termination all Your uploaded Contents will be removed from the Monumental Platform;


You understand and assume all responsibility and risk of any kind when using the Monumental Platform and service of Monumental.
